The Court of Arbitration for Sport issued its decision in the “Lukadia” case, but while confirming the claim of Persepolis club and FIFA’s decision on the issue of unjustified termination, it determined the amount of damage caused to Persepolis from this area as “zero”.
According to Yashgah Persepolis website, the Supreme Sports Court issued its verdict in the case of Persepolis Club’s complaint against Jurgen Lokadia and confirmed FIFA’s decision regarding the unjustified termination of the contract, but his behavior considering that ultimately this action caused There was no damage to the club, he did not consider it necessary to pay compensation to compensate for the damage. Various points have been mentioned in the issued decision, some of which are mentioned below.
In various parts of the decision, the CAS institution has mentioned the unjustified termination by the player and clearly stated in paragraph 104; Despite the reasons given by the player, the unilateral termination of the contract was unjustified.
The sports arbitration court did not accept FIFA’s decision to pay 324,000 dollars, relying on FIFA’s legal articles, in the section on payment of damages by the player.
It was announced in the issued decision; The amount of compensation received should not be more than the amount of damage caused, and in this case, Persepolis club had the possibility and action to hire a replacement player to replace Lokadia. As the contract figure of this player (Pereira) was lower than the contract figure of Lukadia. In fact, CAS believes that in this regard, not only Persepolis was not harmed, but also benefited due to the reduction of the substitute player’s salary.
It is also said; Persepolis club has not paid the transfer fee to another club to sign a contract with the substitute player.
CAS believes; In determining the amount of damages in the case of unjustified termination, the arbitration authority must act in such a way that the exact damages are compensated through the determination of fair compensation. The compensation should not be determined in such a way that the club suffers a profit.
It is also stated in the vote; Persepolis club has not suffered any damage in terms of results due to the unjustified termination of the contract and the absence of Lokadia, because Persepolis won the championship titles in both the Premier League and the Knockout Cup series without him.
Finally, CAS, while confirming Persepolis club’s claim and FIFA’s decision on the issue of unjustified termination of the contract, determined the amount of damage to Persepolis from this area as “zero” due to the aforementioned reasons.
